We value the privacy of our customers’ information and we are always striving to make our customer experience better.  We prepared this Privacy Policy to describe our information practices and, in particular, how we collect, use and share Personal Information, as defined below.  If you have any questions about this Privacy Policy or our information practices, please contact us through the options provided below.

Who We Are

We are Moran Foods, LLC, operating under the brand name SAVE A LOT (“Save A Lot,” “we,” or “us”). This Privacy Policy applies to the information we collect through websites owned and operated by us that link to this Privacy Policy (we call these the “Sites”), to participants of our loyalty program, and to consumers whose personal data is processed by Save A Lot. Throughout this policy, we refer to the Sites, our loyalty program, and your other interactions with us as a consumer as the “Services”. This Privacy Policy does not apply to employees or job applicants of Save A Lot.

Independent Stores

We also have licensing and wholesale relationships with a network of independent retailers that independently own and operate their grocery stores (“Independent Stores”), but who license the use of our brand name and/or use our wholesale distribution network.

Some Independent Stores may operate their own websites or mobile applications, separate and apart from our Services. Those websites and mobile applications are not operated by us and are not subject to this Privacy Policy. Please review the privacy policy posted on those websites or mobile applications to understand the applicable information practices. How We Collect and Use Personal Information

When we use the term “Personal Information” in this Privacy Policy, we mean any information that can be directly associated with a specific person or household, or that reasonably can be used to identify a specific person or household.  For example, this includes your name, home address, phone number, email address, birthday, IP address and unique device identifiers, and any other information that we tie to these elements.

Personal Information does not include “aggregated information,” which is information that we collect about a group or category of persons or services.  It also does not include “de-identified information,” which is information from which we or our agents have removed information that can be used to specifically identify a person, either directly or indirectly. This Privacy Policy does not apply to our collection, use, or disclosure of aggregated or de-identified information.

In the last twelve months, we have collected the following types of Personal Information from you when you use or access our Services:

Information You Provide

We collect Personal Information you provide, for example when you enter the information into form fields on our Sites or enroll in our email or loyalty program. For example, we may collect:

• contact information, such as your name, home address, and email address, which we use to communicate with you and authenticate you as a user;

• demographic information, including age, product preferences, preferred store location and other interests and likes, which we use to better understand and analyze our customer population, support our operations including inventory and product management, to deliver relevant offers and ads, and to improve our products and services including the Site;

• communications preferences, including marketing preferences, which we use to manage how we engage with you;
• application information related to becoming an owner of an Independent Store;
• commercial information, such as purchase history, purchasing tendencies, and other information about your purchases from Save A Lot or our Independent Stores;
• inferences about you from the Personal Information we collect to create profiles reflecting your preferences, characteristics, behavior, attitudes, and predispositions.
• social media profile information, if you interact with us through social media or use a plugin or widget on our Site that connects to a social media platform;the content of inquiries you make;
• any other Personal Information you choose to provide to us;
• any other Personal Information you consent to the collection of at the time of collection

Information Collected Automatically

We use various technologies to collect unique device identifiers such as your IP address, browsing history, the operating system you use, and information about your general location. The categories of information we collect automatically that may be considered Personal Information include unique device identifiers, geolocation data, internet or other similar network activity, and information about your preferences (for example, the time zone that you access the Site from).

The technologies we use to collect information automatically include the following:

Logging Functionality: As is true of most websites, we gather certain information automatically and store it in log files. This information may include IP addresses, browser type, internet service provider, referring/exit pages, operating system, date/time stamp and/or clickstream data.  We generally only use this data for purposes such as security, fraud detection, and protecting our rights.

Cookies and Other Data Collection Technologies: We and third parties we work with use cookies, web beacons, and similar technologies to manage our websites and email messages and to collect and track information about you and your activities online over time and across different websites.  In addition, we use local shared objects (or Flash cookies) to collect and store information about your preferences and how you interact with the Site. These technologies help us to recognize you, customize or personalize your shopping experience, and analyze the use of our Site and solutions to make them more useful to you. These technologies also allow us to aggregate demographic and statistical data and compilations of information, which may or may not include Personal Information, and provide this information to our service providers.

Analytics:  We use analytics providers such as Google Analytics to help us evaluate and measure the use and performance of our Site.  To opt out of the aggregation and analysis of data collected about you on our website by Google Analytics, visit https://tools.google.com/dlpage/gaoptout and download and install the Google Analytics Opt-out Browser Add-on.

Location Information: We may collect location information through the Site so we can offer you certain location-based services (such as delivering advertisements that are relevant to your particular location, and conducting analytics to improve our stores and the Site).

We may use various technologies, including IP lookup, to detect your location so that we can automatically show you the closest store to your area, rather than some random location. Depending on browser type, your browser may inform you that the website would like to collect your location and request your permission to do so. If you allow it, location information is then collected and may be stored locally on your device. If you decline the collection of location information, your location is not collected and you must manually enter your location.

Information We Obtain from Third Party Sources

We may receive additional Personal Information from third party sources, including our Independent Stores, that we may append to existing consumer information, such as email and mailing address verification, and purchasing habits and tendencies.  We use this supplemental information to better understand our consumers, deliver relevant offers and advertising, and improve our operations, stores, Site and our advertising and marketing campaigns.

Additional Uses of Personal Information In addition to the uses described above, we may use your Personal Information for the following purposes:

• Operating our business, delivering our products and services, and for any other lawful, legitimate business purposes;

• Contacting you to respond to your requests or inquiries;

• Providing you with newsletters, articles, product or service alerts, new product or service announcements, savings awards, event invitations, and other information;

• Contacting you about programs, products, or services that we believe may be of interest to you, or sharing with you special offers from other companies;

• Providing you with personally tailored coupons, programs, promotional information, offers, and other information;

• Conducting market research, surveys, and similar inquiries to help us understand trends and customer needs across product categories or customer groups;

• Evaluating your shopping experience or existing products and services, or to create new items;

• Alerting you about a product safety announcement or recall or correction of an offer, promotion, or advertisement;

• Administering sweepstakes and promotions or contacting you regarding a contest prize;

• Preventing, investigating, or providing notice of fraud, unlawful or criminal activity, or unauthorized access to or use of Personal Information, our website or data systems; or to meet legal obligations;

• Enforcing our Terms of Use and other agreements

We may also combine the Personal Information we collect from you directly with information we collect automatically or from third party sources. We may not collect all of the above categories of Personal Information from each and every person who interacts with us or uses our Services.

How We Disclose Personal Information

We disclose your Personal Information with the below categories of third parties for the below purposes. In the last twelve months, we have disclosed all of the above categories of Personal Information with some or all of these third parties.

Service Providers: We share your Personal Information with third party service providers who complete transactions or perform services on our behalf or for your benefit, such as for website hosting, administering the loyalty and email program, marketing, analytics, or to verify customer data, such as mailing addresses.

Legal Process, Safety and Terms Enforcement:  We may disclose your Personal Information to legal or government regulatory authorities in response to their requests for such information or to assist in investigations. We may also disclose your Personal Information to third parties in connection with claims, disputes or litigation, when otherwise required by law, or if we determine its disclosure is necessary to protect the health and safety of you or us, or to enforce our legal rights or contractual commitments that you have made.

Business Transfers: Your Personal Information may be disclosed as part of a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets, and could be transferred to a third party as one of the business assets in such a transaction. It may also be disclosed in the event of insolvency, bankruptcy or receivership.  You will be notified via email and/or a prominent notice on any affected website of any change in ownership or uses of Personal Information, as well as any choices you may have regarding Personal Information about you.

Sales and Sharing of Personal Information and Use of Personal Information for Online Advertising

Save A Lot does not sell Personal Information for money, but in the last twelve months, we have shared Personal Information including identifiers, commercial information, internet or similar network activity, inferences, geolocation data, and unique device identifiers with providers of advertising and analytics services, network advertisers, and partners who assist us with target audience creation. This sharing and disclosure is considered a “sale” of or the “sharing” of Personal Information for the purpose of targeted advertising under some state laws.

If you are a resident of certain jurisdictions, you have the right to opt-out of the sale and sharing of your Personal Information to third parties for these purposes, and to limit our use of your Personal Information for targeted advertising. Please review the section titled “Your Rights and Choices” below, or contact us using the information listed below for more information.

Your Ad Choices

We support the self-regulatory principles of the Digital Advertising Alliance (“DAA”).   We work with a variety of advertisers, advertising networks, advertising servers, and analytics companies (“Ad Partners”) that use different technologies to collect data about your use of the Site (such as pages visited, ads viewed or clicked on) in order to deliver relevant advertising.

These technologies may include the placement on our Site of cookies or web beacons, and other data collection technologies by these Ad Partners to track how our Sites is being used, to track where users go and what they do after their leave our Site, and to link various devices you may use, and to serve you more relevant ads.  These advertisements may appear on our Site or other services that you visit.

For more information about how Ad Partners use the information collected by the technologies on our Site and about your options not to accept cookies placed by some of these companies on our Site, please visit the DAA’s opt-out page. You may also opt out of additional third party advertising networks by going to the Network Advertising Initiative’s website and following the directions.

The opt-outs described above are device- and browser-specific and may not work on all devices.  If you choose to opt-out through any of these opt-out tools, this does not mean you will cease to see advertising.  Rather, the ads you see will just not be based on your interests.  In addition, when you opt out using one of these methods, our Ad Partners will continue to collect information for any other purpose permitted by the DAA’s rules.   You can opt out of future information collection from our Site by ceasing use of the Site.

Please note that this Privacy Policy does not cover the practices of our Ad Partners. Save A Lot does not have control over these third-party technologies or the information contained in them.

Children’s Privacy

Our Site is not directed to, and we do not intend to, or knowingly, collect or solicit Personal Information online from children under the age of 13.  We encourage parents or guardians to participate in and monitor their children’s online activity.  If a child under 13 has provided Personal Information to us, we encourage the child’s parent or guardian to contact us (see the “Contact” section below) to request that we remove the information removed from our systems.  If you are under the age of 13, do not provide us with any Personal Information either directly, on any website bulletin boards, or by other means.

How To Access or Update Your Information

You may review your Personal Information that is readily accessible through our Site or contact us to request that it be updated. If you receive emails from us, you can update your information by clicking the “Preferences” link in any email we have sent you. If you do not receive emails from us, you can update your information by using the information in the “Contact” section below. We will retain your Personal Information for as long as reasonably useful for commercial purposes. We will retain and use your Personal Information as necessary to comply with our legal obligations or data retention policies, resolve disputes and enforce our agreements.

Managing Communication Preferences

If you have provided us with your contact information, we may send you email messages, direct mail offers, or other communications regarding products or services.   At any time, you may elect to discontinue receiving commercial messages from us by submitting an opt-out request to the contact information below or by following the instructions in the form of the communication you received, as described below.

To opt out of receiving marketing materials via email, please send an unsubscribe request to the email address below or click on the unsubscribe link at the bottom of the email that was sent to you and follow the directions on the resulting web page.

Your Rights and Choices

Depending on the jurisdiction in which you reside, you may have additional rights and choices regarding your Personal Information, including the rights listed below. While we use the term Personal Information throughout this Privacy Notice, we intend for this to include “personal data” where that is the term used under applicable law. If you have questions about whether you live in a jurisdiction that affords privacy rights, please contact us using one of the methods listed below.

Right to Request Access or Right to Know

You have the right to request that we disclose information to you about our collection and use of your Personal Information over the past 12 months. You have the right to request the following:

• The categories of Personal Information we collected about you.

• The specific pieces of Personal Information we collected about you.

• The categories of sources for the Personal Information we collected about you.

• The business or commercial purpose for collecting your Personal Information.

• The categories of third parties with whom we have disclosed your Personal Information in the preceding 12 months.

• The categories of Personal Information we sold or shared about you, and the categories of third parties to whom the Personal Information was sold or shared by category of Personal Information.

Once we receive and confirm your verifiable consumer request, we will provide you with the information you request unless an applicable exception applies.

Right to Portability

After you make a request to access or know your Personal Information, you have the right to request to obtain a copy of this information in a portable, readily usable format that allows you to transmit the information to another party, to the extent it is technically feasible. You may also have the right to request that we transfer your information to another organization, under certain circumstances.

Right to Deletion or Right to Erasure

You have the right to request that we delete any of the Personal Information that we collect or retain about you, subject to certain exceptions. After we receive and verify your request, we will delete (and direct any of our service providers that hold your Personal Information on our behalf to delete) your Personal Information from our records, unless an exception applies. We may deny your deletion request if retaining your Personal Information is necessary for us or our service providers, as permitted by law.

Right to Opt-Out of the Sale or Sharing of Personal Information, or the Use of Personal Information for Targeted Advertising

You have the right to opt-out of the sale or sharing of your Personal Information. Information about our practices that may constitute a “sale” or “sharing” of your Personal Information as defined by law are noted in the above section titled “Sales and Sharing of Personal Information, and Use of Personal information for Targeted Advertising.” You may exercise your right to opt-out by following the instructions set forth in this section of this Privacy Notice titled “Exercising Your Rights”. Please note you may also need to update your preferences in your browser settings on each device that you use to access the Services to decline cookies in order to fully opt-out.

In some states, this right is known as the right to opt-out of the use of your personal data for the purposes of targeted advertising, the sale of personal data, or profiling in furtherance of certain decisions.

Right to Limit Certain Uses and Disclosures of your “Sensitive Personal Information”

You have the right to limit our use and disclosure of your “Sensitive Personal Information,” as that term is defined in applicable statutes, where we have collected it to use as necessary to perform the services or provide the goods reasonably expected by you, and as otherwise authorized by the statute and regulations. We do not collect Sensitive Personal Information from consumers of our Services. If this changes, we will only use your Sensitive Personal Information in ways that you would reasonably expect are necessary to perform the services or to provide you with the Services you request.

Right to Correct Personal Information if the Information is Inaccurate

If you believe or discover that Personal Information we have collected about you is inaccurate, you may contact us to request that we correct and update the information so that it is accurate.

Right to Restrict or Object to Processing

You may have the right to restrict certain processing of your Personal Information, or to object to certain processing of your Personal Information, including where our legal basis for the processing is your consent, where the processing involves Sensitive Personal Information, or where it involves automated decision-making technologies. This right is subject to certain restrictions.

Right to Appeal

If you are a resident of certain jurisdictions, you have the right to file an appeal with us if we deny your request to exercise your rights. Requests to appeal can be communicated through the same means by which your request was submitted. If we deny your appeal, you may have the right to appeal to your state regulator. We will provide you the information of the applicable regulator if we deny your appeal.

In addition to the above rights, you also have the right to:

• Appoint an individual to exercise your rights on your behalf, or to exercise rights on behalf of your minor child, if we have collected their information

• Access information about automated decision making (as applicable)

• Opt-out of automated decision making (as applicable)

• To not be discriminated against for exercising your rights

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.

• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will take steps to verify your consumer request, including that you are the person making the request, or you have authority to make the request on behalf of the individual the request relates to. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format: We endeavor to respond to verifiable consumer requests within 45 days of receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination: We will not discriminate against you for exercising any rights you have under applicable law. Unless permitted by applicable law, we will not:

• Deny you goods or services.

• Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

• Provide you a different level or quality of goods or services.

• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services

However, we may offer you certain financial incentives permitted by state law that can result in different prices, rates, or quality levels. Any permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

Links to Other Websites

For your information and convenience, our Site contains links to websites operated by third parties, including, potentially Independent Stores. Our Site also includes features like buttons and widgets hosted by other companies (for example, the Twitter “Tweet” button). These features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. This Privacy Policy does not apply to, and we are not responsible for, the practices of third parties that collect your Personal Information. We encourage you to review the privacy policies of those third parties to learn about their information practices.

Updates to the Privacy Policy

This Privacy Policy is subject to occasional revision, and if we make any material changes in the way we use your Personal Information, we will notify you by sending you an e-mail to the last e-mail address you provided to us and/or by prominently posting notice of the changes on the Site and updating the effective date above.

Any changes to this Privacy Policy will be effective immediately unless stated otherwise in our policy or notice to you of the changes.

Please note that at all times you are responsible for updating your Personal Information to provide us with your most current e-mail address. In the event that the last e-mail address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice.

If you do not wish to permit changes in our use of your Personal Information, you must notify us that you wish for us to delete your Personal Information. Continued use of our Site, following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
